Terms and Conditions – ESMIAN

Welcome to ESMIAN. These Terms and Conditions govern your use of our website and services. By accessing or engaging with ESMIAN, you agree to these Terms in full. If you do not agree, please do not use our website or services.

1. Services

  • ESMIAN offers web design, brand identity, and related creative services. Specific deliverables, timelines, and costs will be outlined in your custom proposal or contract.



2. Client Responsibilities
By working with ESMIAN, you agree to:

  • Provide necessary content, feedback, and access in a timely manner

  • Ensure all content you supply (images, copy, brand materials) is legally owned or licensed

  • Respect timelines for payments and project approvals



3. Payment Terms

  • A non-refundable deposit (typically 50%) is required to begin work

  • Final payment is due before handoff or site launch

  • Late payments may incur fees or delays

  • All prices are listed in USD unless otherwise stated

 
Note:Payment terms will be customized in your proposal or contract.
 
 
4. Intellectual Property

  • You will own all final approved design deliverables after full payment is received

  • ESMIAN retains the right to display work in a portfolio, unless otherwise agreed

  • Unused concepts, drafts, and creative materials remain the property of ESMIAN

 

5. Revisions & Scope

  • Each project includes a set number of revision rounds (as outlined in your proposal)

  • Requests beyond agreed scope may require a change order or additional fee

  • Major changes after final approval may require a new project agreement

 

6. Cancellation & Refunds

  • You may cancel at any time, but deposits are non-refundable

  • If you cancel after work has begun, a prorated fee will be due based on time worked

  • ESMIAN may cancel a project due to lack of communication or breach of terms



8. Limitation of Liability
ESMIAN is not liable for:

  • Loss of income, data, or business due to website issues, hosting errors, or third-party platforms

  • Any indirect or consequential damages from the use of our services

  • Content provided by the client that violates copyright or other legal protections



9. Privacy

  • We respect your privacy and only collect data necessary to operate our business. Your information will not be sold or shared without your permission.

10. Governing Law

  • These Terms are governed by the laws of Maryland, United States. Any disputes will be handled in the appropriate courts of that jurisdiction.

 

11. Updates

  • ESMIAN reserves the right to update these Terms at any time. Changes will be posted on this page with a new effective date.
